My employees found out on Friday that they wouldn't be getting an end of the year general wage increase. That shouldn't have come as a surprise based on the economy, especially the housing market which my company is in. What they weren't prepared for is how much their vacation hous were prorated based on number of hours worked last year.

We had a slow year last year and several of my employees were under the 1600 hours worked in a year cutoff to have all of their vacation hours vested for this upcoming year. Based on longevity, they either get 10, 15, or 20 paid days off, counted in hours.

The problem with the prorating is that the company uses 2080 as the full amount. So, for example, if an employee worked 1599 hours last year, and was expecting to get 160 hours vacation (20 days), they would be prorated based on the following formula:

Hours worked/2080*expected vacation. So in the case of 1599... 1599/2080*160= 123 (just over 15 days). So if they miss the cutoff at all, the minimum number of vacation hours they can lose (if expecting 160) is 37.  ???

It seems to me if 1600 is the cutoff then 1600 should be the number that they use for the prorate divisor as well. Our company is non-union. I would expect that that will change pretty soon. The workforce is very unhappy about this, and rightly so.

Can anyone provide a justification for this formula? Granted, none of my employees were at 1599, but some were close. 1553; 1572; 1566, etc, and all of them lost at least 39 hours of vacation. I find this to be completely unfair, and I, as the manager, am stuck with a workforce full of poor attitudes and my job depends on them performing well.
